Form 10 IE

This query is : Resolved

Quick Summary
This discussion clarifies that Form 10 IE is not mandatory for individuals with only salary income and no business or professional earnings. The option to choose between the new and old tax regimes is now integrated directly within ITR 1 and ITR 2, making a separate Form 10 IE unnecessary for these cases. This change applies regardless of whether the option is also present in other ITR forms.

16 September 2021 Hello, Sir/ Madam
I have a doubt about filing of Form 10 IE for Salaried persons is Mandatory?
If its mandatory, then Salary person is not having any business income or profession income. So, Why not form 10 IE shown in Person don't having business / profession income.
Because I file my client return, Salary person and I file form 10 IE. this form show only in Person having business/ profession income and some mandatory field is selection of Sector or sub sector. If I m salary person so why I choose for sector or sub sector.
Please help

16 September 2021 For the assessee having no business/professional income; i.e. for filing ITR 1 & ITR 2, there is no need to file Form 10 IE separately. There is option given in the ITR itself, for opting New/old tax regime, in the questionnaire. That is the reason department has removed the form for assesses not declaring business/professional income.

17 September 2021 Not mandatry for assesse's having only salary income. Inference :- section 115BAC(5) r.a.w. rule 21AG(1).
Ps:- It is not because of option in ITR-1 and 2. Option is also given in ITR 3 and 4.
