04 March 2011 My friend is working in forign company. He works only 9 months on ship & 3 months at home in India.His company paying him as a salary but comapny not provide form 16 then on which basis i can file his income tax return ? and what is procedure of filling return ?

06 March 2011 In the given situation his status is that of an NRI in respect of the Salary Income from foreign ship. He is not required to file his Return in respect of his Salary Income.

He is not liable to file IT return in India, provided he is not having any other sources of income in India.
