gud evening sir...plz answer my query
if company fails to registered charged within 30 days to roc..
rule 3 (3) of cos (registration of charge) charge holder will file that CHG-1 to roc alongwith fee..
my question is that fee paid by chargeholder will he reimburse from company? or bear himself?
The CHARGE holder initiating such an action means relations are NOT cordial.
Let him demand the same from the Company so that, may be. at the time of enforcing charge, the same may be recovered.
But there is NO any specific rule as to who should bear it. Companies Act has cast the duty to the concerned Company. The Company has failed register the CHARGE.
Since it is in the interest of CHARGE holder, it registered the charge.
