17 January 2017 Hi,

My client is starting an Educational Institute. He wants to operate such a way so that he can claim exemption available for Educational Institution.
So my doubt What should be done for claiming the exemption Later?

1. Weather he can start Educational Institute under private limited company? Yes or No?
2. If No what can he do for availing exemption?
3. If yes what shall be the procedure.

17 January 2017 1. A Company can start educational Institute
2. There is no procedure for availing exemption
following service provided by and to educational institute are exempted as per clause 9 of notification 25/2012 as amended from time to time
Services provided,-
(a) by an educational institution to its students, faculty and staff;
(b) to an educational institution, by way of,-
(i) transportation of students, faculty and staff;
(ii) catering, including any mid-day meals scheme sponsored by the Government;
(iii) security or cleaning or house-keeping services performed in such educational institution;
(iv) services relating to admission to, or conduct of examination by, such institution;”;

As per my knowledge you have provided the reply from Service Tax point, my doubt is regarding Income Tax Exemption for Educational Institute. Can a company (Educational Institute) claim IT exemption ?

1. If yes, what procedure is to be followed while registering company? Should we give application to Chief Commissioner of director General asking for Exemption at the first itself?

2. or we can claim exemption at year end?

18 January 2017 You have to register the Company u/s 8 of Company Law to avail exemption from Income tax u/s. 10 (23C)
