one employee is not ready to pay his portion in esic scheme. he says that he is not required to join esic scheme. so let me know that whether the employee can deny it

no, if no of employee and salary of the employee eligible then esic will applicable.

but employee is not ready to contribute his portion in to EPF. and there is no any clause that employee should contribute in EPF. so what?

and of course employee can earn more return by investing in other market than epf

The deduction is in the hands of employer, and it is his liability to deduct the contribution from salary!!
