15 July 2009 IN A COMPANY TOTAL EMPLOYEES ARE 25. 15 EMPLOYEES ARE GETTING BASIC WAGES MORE THAN 15000/-.

COMPANY WILL BE COVERED UNDER ESI?

15 July 2009 Dear Friends....

a private limited company is reimburshing the transport expenses of employess (from residence to office )

is it taxable in the hands employess

as Transport allowance is 800 P.M from I.T

and they are reimburshing more than 3000 Rs. P.M (except Transport Allowance)

Esi Is Only Applicable For Those Who Are Below 10000 And Upto 10000 And Not Above.

apply to cos where > 20 employees ...but it doent say 20 ees should be less than 10000.....so ESI applicable to cos were >20 ees are workin

NO. Your Company will not be covered under ESI.

Apply to co. where min 10/20 employees are employed and all are getting basic wages less then 10000.

Applicability

The ESIC Act applies to non-seasonal, power using factories or manufacturing units employing ten or more persons and non-power using establishments employing twenty or more persons. Under the enabling provisions of the act, a factory or establishment, located in a geographical area, notified for implementation of the scheme, falls in the purview of the act. Employees of the aforesaid categories of factories or establishments, but drawing wages only up to Rs 10,000 a month are entitled to health insurance cover under the ESI act.

The wage ceiling for purpose of coverage is revised from time to time; to keep pace with rising cost of living and subsequent wage hikes.
