20 February 2013 if extension of export obligation beyond 8+2 year can be considered for a further period of two years with condition that 50% of duty payable in proportion to unfulfilled export obligation is paid to customs - para 5.11 of HBP Vol. 1 2009-14 - MF (DR) Circular no 16/2006-Cus dated 09-05-2006.
if the party fulfills whole of export obligation , whether 50% amount deposited with custom, will be refundable

05 March 2013 Extension for fulfilment of export obligation upto two years can be obtained from RA on payment of composition fee of 2% of proporttionate duty saved amount on unfulfilment obligation or an enhancement of total export obligation by 10%, at the choice of exporter, for each year of extension sought. Such first extension of Export Obligation cab be maximum period of two years - para 5.11 of HBP Vol. 1 2009-14.

05 March 2013 dear sir,

your answer to the extent mentioned is correct. but my query is after the completion of tenuere of EPCH, thereafter it can also be extended by paying 50% of custom duty on unfulfilled obligation.

if a person complete the obligation, whether amount deposited being 50% of unfulfilled obligation will be refunded ?

06 March 2013 now you submit a request letter in concerned DGFT office i hope concerned RJDGFT office will refund ....

07 March 2013 DGTD is taking the position , it is the nature of penalty and moreover the payment has been deposited with custom office.
