employees rights for form 16

01 February 2010 HI,

My previous employer is denying in providing provisional form 16 for the duration of march to dec-2009.
In december I resigned from that company.

My current employer is asking me for provisional form 16 and says that it my right to have it.

Is there any law under which I can force my X employer to provide provisional form 16.

Please advice.

01 February 2010 Form 16 is usually issued in the month of April, but there is no provision for issuing befoe that and if the employer wants issue before that they can issue while resigning

If the employer not issue form 16 after the due date (i.e.April 30) there is the penalty for Rs.100 perday from the due date to till the default continues

For providing information to present employer you can ask the tax calculation and tax deduction details
