while making application for DIN number two times fee was paid because of technical error and get two DIN. now I have to surrender one DIN.
Form 5 is applicable when the person want to surrender DIN but not for that person who have duplicate DIN.

Your observation seems merit . However,Form DIR-5 can be used to deactivate either one of the DIN, provided condition as in rule 11(f) is satisfied by the DIN holder. Care may be taken to fill up clause 3 of the said form and an affidavit in support of the reason will help to solve the issue.

Before some time i have saw this clarification. MCA Clarification on existing duplicate DINs:
Cancellation or surrender of Duplicate DIN The cancellation or surrender procedure has been prescribed in Rule 11 of the Companies (Appointment and Qualification of Directors) Rules, 2014 is as under: (a) Holder of duplicate DIN shall make an application for surrender. (b) The application shall be in Form DIR-5 >> (c) The application shall be accompanied with a declaration that he has never been appointed as director in any company and the said DIN has never been used for filing of any document with any authority.
