19 February 2011 sir we faild to file audit report for the ay 2008-09 within due date. we received penalty notice in this respect. Now we have resnable cause of not filing within due date. i just want to ask you whether below drafted replay is ok or something more is needed in this replay to justify the ACIT to stop the penalty proceeding. we have all the evedence in this respect:

Subject: Request for condonation of delay in filling of Tax Audit Report for the A.Y. 2008-09
Ref: Notice u/s 274 R.W.S 271B of Income Tax Act 1956 Dated on 08/12/2010

Respected Sir,
With reference to above subject I hereby request you to condone the delay in respect of filling of Tax Audit Report for the A.Y. 2008-09 & not to initiate penalty proceeding u/s 271B due to following reason:

Sir from 1st Sept 2008 our accountant Mr__________. has left the services without finalizing accounts & anther accountant was appointed in his place that resulted in delay in finalizing the account as well as getting the accounts audited & hence caused delay in submission of Audit Report.
Sir we have attached herewith the affidavit of Mr.______________ duly notaries on 18th Feb 2011 for your ready reference.

So considering the above facts the penalty proceeding may kindly be stop by your honor & make justice in our case.
