Donner giving corpus donation can be claim under 80 G?

15 August 2010 Dear All,

Pvt ltd company giving cropus donation to a Charity trust (having 80 G certificate), can the same be claimed as deduction under 80 G by donner company. Normal donation or corpus donation will make any difference for donner while claiming deduciton under 80 G.

15 August 2010 Normal donation or corpus donation does not make any difference as far as donor is concerned. however, for donor there is ceiling limit upto which the benefit is allowable. If the amount of deduction to a charitable organisation or trust is more than 10% of the Gross Total Income computed under the Act (as reduced by income on which income-tax is not payable under any provision of this Act and by any amount in respect of which the assessee is entitled to a deduction under any other provision of this Chapter), then the amount in excess of 10% of Gross Total Income shall not qualify for deduction under section 80G.

whereas Trust has to make separate treatment/disclosure for such receipts.
