07 October 2014 Greetings to all ....

I have to appoint a director from back date i.e. January 2013, now do I have to file form 32 or form DIR-12 for the same. Also, attachments are required to be in accordance with Companies Act, 1956 and 2013?

07 October 2014 File Form DIR-12 with following attachment

1. Consent to act as a director in DIR- 2
2. Interest in other entities
3. Letter of Appointment (if any)

07 October 2014 Thanku Sir,

But he was appointed when there is Companies Act, 1956. But these attachments are according to Companies Act, 2013.

07 October 2014 Since you are filing DIR 12, attachment need to be as per companies act 2013 though director was appointed back dated.

07 October 2014 Form 32 is not available now and it would be impossible to file form DIR 12 with form 32 attachments.

You have to file form dir12 with attachments prescribed under companies act 2013. You have no other choice but to collect and file desired documents through form dir12.
