Section 140(2) says file adt-3 within 30 days of resignation....
Section 140(3) says penalty of minimum 50k for not following section 140(2).....
My question is that if a person file adt-3 after 30 days then will he still have to pay this penalty or only failure to file adt-3 will result in penalty........

Failure attracts penalty. Delay attracts payment of additional filing fee.

In case of delay Additional fees will be levied as follows:
Period of Delay Additional fee
Delay upto 30 days 2 times of normal fees
30-60 days 4 times of normal fees
60-90 days 6 times of normal fees
90-180 days 10 times of normal fees
Above 180 days delay 12 times of normal fees
Period of Delay Additional fee

I know about fee for delay...my question is whether penalty of section 140(3) will also apply for late filling...
