My client is a single lady who has ventured into business for the first time and has no prior knowledge or experience in the line.
Due to this reason, there has been a years delay in filing her service tax returns. Is there any way, we can avoid the penalty ?
Any case laws to substantiate my case ?

take up your case with Commisisoner. He can condone the delay in case sufficient explanantion is furnished..

I beg to differ with answer provided by ld Hitesh, even commissioner dont have right to condone delay, also condonation can be done only where there is nil service tax liability
