Deduction for salary that is recovered

This query is : Resolved

12 February 2017 One of my client received arrear amount during the FY 2014-15. She has paid the Tax for that amount in that particular FY. This year there was an amendment in the rules and it is found that the arrear amount was paid wrongly. So now she is repaying the arrear amount through her salary bill. Now the question is
1. whether she can deduct the amount which she is repaying?
2. if she can claim the deduction under what head she has to claim?
3. is she able to get the tax already paid as refund?
Thank you

12 February 2017 1 Yes she can deduct the amount in the current year salary payment.
2 claim deduction under salary head only.
3 In view of deduction claimed tax liability gets reduced.

14 February 2017 Thank your sir. one more question is there any deadline for filing form 10 e. I want to file 10 e for AY 2017-18. but it is not enabled in IT website.

14 February 2017 Wait till April/May, no need of hurry.
