Death of Karta of HUF leaving Widow and minor child.

09 July 2011 Dear sir,

I need advise, regarding as follows:

A HUF consisting Karta, Wife and minor son. Since HUF is running a business of bricks. However, due to unfortunate accident, the said Karta has died leaving behind widow and minor son.

my query is :

1. can a widow become karta of huf ?
2. can she operate bank a/c of HUF?
3. can she open new bank a/c, with the name of deceased karta ?

kindly provide me advise.

Reply- The Suffix "HUF" has to be added.

10 July 2011 kindly provide if any case laws is existed.

However, department personnels say that "After the amendment of Indian succession act, 'female can be conpracener but not even written anywhere that female can become karta in case of widow."
