04 January 2010 Hello Sir,
I have my manufacture unit in Palghar, Maharashtra having manufacturing excise licence. My office is in Mumbai having dealer excise licence. To sale my product in very small quantity, I am doing retailing activity from my office. I am removing my material from my factory to my office with excise gate pass. After that retail sale is done on commercial tax invoice from this office to all end users. The annual turnover of my office is not more than 24 Lacs.
For very small amount of sale I had taken Dealer excise licence, as it is suggested by my consultant(As per his view, same proprietor can not do any trading or manufacturing activity without excise licence.)
As I am not doing any trading activity other than selling my own product, & I have no plan to pass excise modvat to end user.
Please give me solution to overcome from this paperwork & is it possible to surrender my dealer excise licence?

04 January 2010 If you don't want to pass on CENVAT credit to the purchaser or don't want to issue CENVAT invoice, there is nothing in Central Excise provision which compel you to hold Central Excise registration.
