Credit of ST paid by CA

24 November 2007 Sir,

I am from Pharmaceutical company.

We are manufacturing and also sale the third party (TP) purchased goods received from other state.

We sale both the goods (means self mfg.ed goods and TP goods ) to Super stockist and Consignment Agent.

We are paying the amount to CA which amount they will pay service tax.

CA agent are paying service tax through GAR-7.

After paying Service tax by CA through GAR 7 (TR-6), can we avail the service tax credit?

27 November 2007 ONLY A REGISTERED SERVICE PROVIDER UNDER SERVICE TAX ACT CAN AVAIL INPUT TAX CREDIT ON THE SERVICE TAX COLLECTED AND DEPOSITED BY HIM.
SO, IF YOU ARE REGISTERED UNDER SERVICE TAX ACT AND IF THE SERVICE TAX IS COLLECTED BY YOU AND THEN THE SAME IS DEPOSITED BY YOU, THEN ONLY YOU CAN CLAIM INPUT TAX CREDIT.
SIMILARLY IF YOUR CONSIGNMENT AGENT IS REGISTERED UNDER SERV. TAX ACT AND IF HE COLLECTS THE TAX AND IF THE SAME IS DEPOSITED BY HIM, THEN HE IS ELIGIBLE TO CLAIM THE SAME.
