Whether a company can avail credit of service tax on Construction bill of Factory Building. The contractor charges service tax 12.36% on 33% value of total bill amount. ( after availing 67% abatement). Whether we claim credit of service tax.

w.e.f. from 1.4.2011 it is not permissible. In Union Budget 2012-2013 Govt. has define Negitive list but still notifications clarifying this is still awaiting. In this circumstances The finalce bills 2012-2013 has met ascent of parliament on 30.5.2012. you have to wait some more time till CBEC issue guidelines for the same.
