11 August 2008 We have made a payement to Transpoter on account of "Octroi". we had contract with them for Octroi.Payment made on behlaf of us & they charged 3% as a service charges on octroi amount & after that i.e. Octroi Amount + Service charged they claim Service tax on Serivce Amount.
please let me suggest Is it possible,they will claim for service tax? if Yes then is is possible for us to take the credit of the same amount

18 August 2008 Service tax will be charged on the gross amount charged by the transporter whether it includes octroi etc. Because the whole amount paid to the transporter is on account of Service of Transportation of goods from one place to other. therefore we will have to pay the service tax on the whole amount paid to transporters without breaking it into parts. However, abatement of 75% can be availed.
