By mistake payment of out put service is done , which is to be paid by customer . is there any legal option to get back the payment

I think you and service receiver both had to deposit their part of service tax. Service receiver was covered under RCM & by mistake you deposited S Tax for both. In such situations even the full S Tax has been paid by you, service receiver has to deposit his part of tax. Either you can claim refund or adjust such excess payment from next or other service tax payments.
