I have to know that if a company named ABC ltd. taking a loan from a financial institution on the mortgage of immovable property of XYZ ltd. then who have to create a charge at ROC?

Generally it is the responsibility of COMPNY to file form 8 .

It is the duty of a Company to file with ROC for registration of charge (Refer Section 134 of Companies Act, 1956).

Totally agree with CS vanita…It is duty of a company to file form-8 for creation of charge u/s 134(1).
