03 March 2012 Whether a person qualified the final examination but awaiting membership can act as a Company secretary? Is their any problem in filing form 32 for such a person?

04 March 2012 Section 2 1 (C) of co. secretaries Act 1980 defines - "Company Secretary" means a person who is a member of the Institute;
No person shall be appointed as whole-time secretary of the company having paid up capital more than 5 cr. under sub-rule (1) unless he is a member of the Institute of Company Secretaries of India constituted under the Company Secretaries Act, 1980 (56 of 1980).

04 March 2012 Agree with Priyanka Ji. Further, you simply can not appoint him as in form 32 you need to mention the membership no of the person to be appointed as company secretary. Plz check the form.

Membership is obtained only on obtaining Unique Membership Number which is obtained only on completion of all trainings!!!!
