26 November 2014 Does misconduct of code of ethics apply on filing 3ceb (transfer pricing report) without prior communication with tax auditor of the same entity? clause 8 & 9 of 1st schedule of code of ethics apply on auditor appointment not on appointment for some other assignment. Can some CA in practice submit entity's 3ceb report without first communicating tax auditor of that particular entity? pls clarify with rules.

26 November 2014 Comminication with the previous auditor has always been regarded as a MUST practice by the incoming auditor. It should NOT be looked upon as the HINDRANCE in getting the work rather it is an opportunity to know the assignment in a better way, from the experiences of the previous auditor.
There are different types of Income Tax audit and for each type a separate auditor may be appointed.
The intentions seem to be clear that communication with the PREVIOUS AUDITOR should NOT partake the view that newly appointed auditor should comminicate with each and every type of previous auditor.
