I would like to seek your kind guidance regarding the filing of the FC-TRS Form in connection with a share transfer transaction involving the following entities:
ABC Private Limited – Investee Company (whose shares are being transferred)
PQR Pvt. Ltd. – Resident Transferor
XYZ PTE Ltd. – Non-Resident Transferee
In this regard, I request your clarification on the following points:
Which company is required to register as the Entity User and Business User on the FIRMS Portal for filing the FC-TRS form?
For the purpose of submitting the Authorization Letter, the Authorized Dealer (AD) Bank of which entity (Investee, Transferor, or Transferee) should be approached?
I would be grateful for your guidance to ensure compliance with the procedures under FEMA and RBI regulations.
