change in service tax rate from 24.02.2009

02 April 2009 One party has prepared the invoice showing as "invoice for the month of march". In which it is also written that date of commencment of services 20.01.2009 and date of completion 30.03.2009.
It is not possible to get new invoice from party.
Is service tax rate will be 12.36% or 10.30% for this invoice?

02 April 2009 If dates are clearly mentioned then upto 23-2-2009 the rate of tax will be 12.36% and from 24-2-2009 to 31-3-2009 it will be 10.30%.

If you raise a bill without mentioning the service dates and if you raise before 24-2-2009 it will be 12.36% and if you raise a bill on or after 24-2-2009 then it will be 10.30%

02 April 2009 If your services are completed on 30.03.2009 then you can raise invoice by charging service tax @ 10.3% irrespective of the moth or date when it was started. Further, pls note that your services are continuous from 20.01.2009 to 30.03.2009 and your only billing on or after 30.03.2009 and entire amount is received on or after 30.03.2009.
