as per finance act 2009 w.e.f. 19 th Aug,2009 no cess applicable on TDS, but if one has deducted cess and deposited it in the authority, can he refund back the cess amount or not.

No need to claim refund, just give certificate to deducteeshowing the cess deducted and he will claim the cess on TDS in his return.
Moreover cess is not applicable w.e.f 01.04.2009 and many of us deducted till the mid year as finance act enacted later.
