05 November 2012 Dear Experts

when we import we are taking CVD and Additional duty as Cenvat.

Now CVD is 12% Edc Cess is NIll.

For Manufacturer when we take CENVAT benifit there will be diffirence of Education cess amount agst duty payable.

Please clarify whether we can make payment of only Education Cess without cenvat and the can be adjusted through PLA.

05 November 2012 You can take Cenvat only CVD basic portion for eligible capital goods , Education cess on CVD has been removed.

you can pay only Education cess , there is no bar.

05 November 2012 Imported material is used in manufacturing process and it not capital goods.
What about Additional duty for CENVAT

05 November 2012 You can take the cenvat credit on imported inputs on the part of CVD and SAD. You can utilized these cenvat credit in regards to duty payment of final product. you can pay the education cess and HS. cess from PLA.
