19 August 2013 IF SELLER IS NOT REGISTERED WITH EXCISE DEPT, HOW CAN THE SELLER COLLECT EXCISE DUTY TO CLAIM CENVAT CREDIT?

19 August 2013 seller is a dealer. he is charging Excise duty on the bill but at the same time he is not registered. so sld we pay hm the amount excluding excise duty??

19 August 2013 Paying excise duty portion is the understanding between you and party or terms agreed by both. Ask the party to get him registered as First Stage Dealer in future and to pass the benefit of cenvat. Otherwise, you have to purchase the materials only from registered dealer to avail the cenvat.
