Can two clearing forwarding service private limited companies amalgamate, since it is not an undertaking u/s72A

whether an existing clearing forwarding agency(Pvt ltd company) can take the loss of another clearing forwaring agency( private limited company).

28 June 2011 In my view , there is no such restriction exist in case of amalgamation that the amalgamated company can not c/fd the losses of amalgamating company.
For amalgamation a scheme of amalgamation is required to be approved by the court, as I know.
Please take the opinion of other experts also.
