Hi,

I have registered for Intermediate Course during August 1998 and completed my articleship during September 2001. I believe the following details would be helpful for your opinion:

a. I have completed my B.Com during 1998. I have not cleared any of the Intermediate Group.

b. I have appeared in PE II examinations also and i was not successful in this course too.

c. I have written my Nov. 2007 examination in PEII both the groups.

My question is :

1. Am I eligible for appearing May 2008 examination in PEII if I am not successful in November 2007?

2. If I am not eligible, can you please advise me whether should I register for Professional Competence Course?

3. I happened to read the FAQ of ICAI and as per qeustion no.4, I understand that an Intermediate student who has not passed any of the Intermediate Groups and have not passed the Foundation Examination will be allowed to appear in PEII to be held in May 2008.

Inference is drawn to Q.No.1 here which reads, if a student has got examption under Regulation 25B(1) from passing PE I, then the restriction of 5 attempts is not applicable and he / she can appear in May 2008 Professional Education Course II.

In this scenario, please advise me whether i am eligible for appearing in May 2008 PE II Examination.

Applicability of VAT audit

A proprietory concern is involved in providing technical labour, technical consultancy as well as sales. It is subject to tax audit under Income Tax as its gross collections from all the three sources taken together exceed Rs 40,00,000 . However amount of sales is hardly around 50000/-. Would it be subject to VAT audit?

Mrs X had purchased land before 1.4.81 and constructed building on it(Grnd + 2). Her sons formed a partnership firm in say year 2000 for constructing additional 3 floors by acquiring a TDR from XYZ ltd.Mrs X passed away in the year say 2004 and by will the property passed in favour of her sons.Now they have retained the 1st floor for their residence and the rest have been sold in the year 2006. so my question is:-
a)how do i calculate capital gains tax ?

b)the firm in its B/S shows that it follows Project completion method but have not recognized revenue according to the said method so far and the land and the buld is not trf to firm. so should partners trf asset at book values and then calculate capital gains tax or.....?

Plz help me out with this query of mine ASAP!!!
