Dear Members,
An unlisted public co. Borrowings crosses 50Cr as on 31st Mar,2019.Paid up capital is below the limits prescribed. An Audit firm was serving as auditor for past 10 years and is reappointed for another term of in AGM held in 2019. Kindly clarify the below issues:
1. Are the limits prescribed in Rule 5 of the Companies (Audit and Auditors) Rules,2014 to be checked “At “ the time of appointment of audit firm?
2. For the calculation of term specified in section 139(2), the period served as an auditor before the applicability of limits specified in Rule 5, be counted?

Ind AS applicability

Hi all,
I have doubt on IndAS.
On 15.03.2021 listed co acquired privte company.
Here my doubt is,
1.Whether subsidiary of listed companies are required to file quarterly/ year to date financials.
2. If yes, is it required to be prepared for quarter ended march 2021.
3. What is the due date for filing quartely/ year to date returns?
4. Is Peer review of auditors mandatory for auditors of subsidiary of listed companies ??

A private limited company was set up for manufacturing business with authorized and paid up capital of INR 25 Lakhs.
The manufacturing business has been closed down.
Bank interest has come to all time low.
Can now the share capital be used for investing in shares/bonds, i.e, buying delivery (not intraday trading) in demat account and selling as and when their prices go up, which can happen in days, weeks and or months.

I have an urgent query on Loan from individual in to private limited company, request you to please reply to these queries: -

1. Loan received from Mr. X in 2019-20 and filed instead as a loan from director (Mr. Y) to company, later at the stage to repayment realized that payments have to be released directly to the Mr. X. Please advice how to pass correction here and pay directly to the Mr. X in year 2020-21.

2. loan received again in May 2020 from Mr. X in 2020-21 and made him shareholder too in Nov 2020 then how will we treat both the loan while paying in year 2020-21 along with Interest payment.

Please reply as soon as possible.

Amendments in Companies Act, 2013

Hi all,

MCA made the further amendments in Schedule III to the said Act with effect from 1st day of April, 2021.

Here my doubt is whether such amendments are applicable to financial statements pertaining to FY 2020-21 onwards or for financial statements pertaining to any period given after 01.04.2021. Eg : We have to give financials for a 15 month period at the request of client i.e., from 01.01.2019 to 15.03.2021. Whether i have to follow old Sch-III or amended one.
Please clarify.
