We imported the material and paid customs duty also. After receipt of material we found that the quality is not upto our standard and we can't use the material also, subsequently we rejected and scrped the material.
Whether we can able to get back the customs duty from the department whcih we paid for defective material?
Can i get any notification/court judgement in this regard?

As per new rules er2 form has to be filed all eou units within 10 of every month, as few doubts in filling the form, our company has not done single import till date so the question of filling import column does not arise, what other details needs to be given could anyone pls let me know.
I have been doing Exports from India for the past two years.
All of my shipments are on NON DRAWBACK that mean a Free Shipping Bill.
When I send a shipment I sent a set of following documents -:
SLA Shipper Letter of Instruction
SDF Shippers Declration Form.
Invoice
Packing List.
Now the payments which I receive is in my Indian Bank account is USD converted to Indian Rupee.
Bank issues an FIRC for the same.
Now I have a SALES TAX matter where I have to get money refunded on the EXPORT done outside India.
The sales tax dept requires BRC (Bank Realisation Certificate)
When I approach the bank, they ask me for the following -:
Invoice
Request Letter
Shipping Bill copy
SDF Form.
When I re-checked the files many I have all the EXPORT DOCUMENTS like Shipping Bill, Exchange Control Copy, Invoice, HAWAB and the AWB
But many doenst have the attested copy of SDF's ?
What do I do now to have many BRC ???

Whether export duty will be applicable on Medicines meant for Personal use. Whether the consignee has to pay duty at the time of collecting the medicines?
I have to send some medicines for my sister who stays in London. The medicines which are to be sent are general medicines which are meant to be used for personal use (viz., Vicks/ Amrutanjan/ Kneecap/ Headache tablets/ Painkiller tablets etc.)
I have been told that for sending such medicines abroad, one needs to provide a Doctor's prescription, Medical Bill for the medicines purchased and a Declaration from the consignor that the medicines are meant for personal use.
Query 1: Whether the Doctor should be a MBBS doctor or an ESI doctor/ Govt Doctor?
Query 2: Whether such medicines sent will partake Customs Clearance and also whether Customs duty will be liable for payment?
Whether payment of customs duty by a lessee on import of plant and machinery automatically confer ownership rights on the lessee assuming that the lessor supplies the same on lease basis but not on sale basis?
