13 February 2012 I am a proprietor of construction company,
last year 2010-2011 audit was done on 5 Oct'2011 but due to some reason i have not filed my IT return yet.

Do I need to pay any panelties for that or i can efile my IT return now ?

13 February 2012 You can efile your return now. At the time of scrutiny assessment the AO satisfies with you explanation of reasons to not filing of return and audit with in due date he may exempt you from penalty otherwise he may impose penalty.
