17 January 2014 removed from factory 17.01.2014
assessable value and tariff rate as on 17.01.2014 respectively 200000 and 8%

sold these good from ex Mumbai depot on 15.02.2014
assessable value and tariff rate as on 15.02.2014 respectively 250000 and 14%

please advise correct value and rate.

17 January 2014 Your query is not clear you should consult with any professional. Duty will be payable on highier value.

19 January 2014 If goods have been cleared from factory to depot on payment of duty by following correct methodology for ascertainment of assessable value, the duty liability stands discharged irrespective of the fact that at what price it is sold from depot or on the date of sale there is change in duty structure provided depot does not issue cenvat invoice.

19 January 2014 If assessable value will be increase on depot of the manufacturer then duty will be payable on higher value.
