20 March 2008 CAN A CA SEND HIS ARTICLED CLERKS AS A STAFF TO SOME PVT COMPANIES, FOR DOING SOME WORK OTHER THAN ACCOUNTS , AUDIT AND TAX?

20 March 2008 A CA HAS SEND MY BROTHER TO SOME BANK AS A TEMPORARY STAFF. NOW EXACTLY WHAT HE SHOULD DO? HE IS NOT INTERESTED IN DOING THAT JOB? HIS BOSS IS NOT RELEIVING HIM FROM THAT JOB?

20 March 2008 This is not allowed as per ICAI if he is treated as staff. If he is sent as Article then the CA is right. The word temporary indicates it is an arrangement for some time. Tell your brother to complete it. No need to panic.

20 March 2008 The principal can not take any private work from the article clerk however principal can do the same if it is normal course of business of the firm.

21 March 2008 It is a data-entry job,in a bank which is nowhere related to audit or accounts.He has been doing this for last 6 months.He is not been assigned us to any audit.Can he outrightly refuse to do that type of work and get a transfer certificate from the firm?
