Appointment of director in a pvt ltd company

15 July 2015 Hello Sir,
I am working in a government undertaking PSU bank for the last three years. Two months ago I have been charge shetted for violating banks lending policy and negligence of duty. The final verdict cut down my two increments.
Now I want to leave my job and resign. I want to start my own business.
Just want to know if I go for incorporating a Pvt Ltd company , can I be appointed as a full time director of the company since I have been chargeshetted in my previous job??
If not then what are my options??

16 July 2015 Dear Sir,

As per my opinion read with section 164 of Companies Act, 2013, you are not disqualified to be appointed as Director since you were to not sent to imprisonment.

For more clarity you are advised to refer section 164 of Companies Act, 2013.
