dear sir,
. my client has started a new business as propritoryship concern. they are into business of data entry operator. they provide this service to mobile service company .i wanted to know the following
1) whether service tax is applicable, if yes under what service and at what rate .
2) if we register for service tax is it compulsory to file the return quarterly/ monthly
3) they have employed 12 persons on a salary between (7000k-12000k) whether they have to register for TAN
please clarify for the above points

1. The nature of the work undertaken by your client seems to be of contract type. When the billing crosses Rs.9.00 lacs, immediately he should register himself for Service Tax.
2. NIL return is also compuslroy in Service Tax.
3. No need to have TAN number right now. But it is advisable to take TAN so that in future it would be used whenever TDS become payable. NIL TDS returns are not required.

and your s.t rate would be 10% + 3%
TAN is used for your salary payments if salary of your client staff goes taxable when your cline has to deduct tax on tan.
