If CIT (A) has passed a order allowing a expenditure but dept. file further appeal to ITAT. so until the appeal is pending in ITAT which judgement shall prevail.

The asessment order ,giving effect to the CIT (A) order, passed by the AO will prevail till the disposal of the appeal by the ITAT.

But AO is not allowing. Is there any judgement of hc or sc in support of your view sir..
