19 August 2014 A Painter was awarded a contract to paint a building @ Rs. 20 per sq feet. This is the contracted amount. In case the painter used paint above a decided quantity, penal recovery of Rs. 4 per sq feet shall be made AS PER CONTRACT. Finally painter was paid Rs. 16 per sq feet. Assuming other criteria of levy of service tax are met, whether service tax will be paid on Rs. 16(actual amount paid) or Rs. 20 (Gross amount as per contract). Please also give the reasons...
