Amendment of e-form 32

09 August 2010 Can an e-form 32 be amended post submitting the same, if there are errors made in the form? If then how? Further, what is the document required to be attached in the e-form 32 to evidence resignation of a director?

09 August 2010 Once the e-form 32 is approved by MCA 21 portal, there is no provision to amend the same. However the company can file another e-form 32 afresh, with fees ,rectifing the defects in the earlier with an optional attachment clearly mentioning the defects in the earlier one. Thus both the forms will form part of permanent record in MCA 21 and on a combained reading of the same the purpose of the second filing and the correct position can be known to the viewer.

For the resignation of the director, resignation letter/ death certificate,in case of death, along with board resolution should be an attachment to the e-form 32 filed thereon.
