Sir
My unit is one of a Divisional office of State Government Company which is engaged in Power Generation and distribution.
My unit is having Independent PAN number. My unit avail services. How can i register under service Tax ? I mean what will be my Unit's constitution ? A Company ? I guess No. Please suggest.

The vital point is who owns the unit? If it is owned by State Governement or Electricity Board then you have to find out the answer yourself that are you paying the VAT? If yes then no Service Tax. The answer is very simple where VAT is paid no Service Tax and where service tax is paid no VAT except in case of contracts.

You have stated that u r having separate PAN for DO. Please clarify here how r u filing the Income Tax returns of DO, whether separately or part of company. If separately what is status of DO as per Income Tax. Further how r the accounts being prepared , whether or not the DO financials are included in the cos financials or not? These questions need to be answered before providing concrete opinion on ur issue.
