can an Auditor take advance payment of his statutory audit fees?
If yes wouldn't he activates provisions of section 226(3)?...

Statutory Auditor can be made Advance Payment and the same will not attract the provisions of Section 226(3), there is a clarification of ICAI on the same issue.
