27 January 2009 if an assessee have a property and the property value is decided by court is less than the value decided by stamp value officer. what will be the sale consideration according to sec.50c. either value by court or stamp value?

27 January 2009 Value as decided by the court. Even if the appeal is pending in a court against the stamp value of a property, the sale consideration may be taken lesser, but if later on the decision goes in favour of stamp authority, assessee will have to pay cap gain accordingly.
