and now a days we are filling e return than how will the income tax department will come to know that the person is dead and on his be half his representative is signing the return..... because nothing is asked in the form like the person is dead or alive

The death claim is received by nominees in the policies and these are tax free amount. . It is not necessary that the same person should be treated as legal representative(LR). If nominee is his wife, his return can be filed by her or his major son. . For the removal of doubt, a separate return of the expired assessee will be filed as if he is alive. But the verification on ITRV will be made by the LR.
LR is if an assessee, he will show his own income in his personal return.
. You have to tick against the clause -Whether return is being filed by representative assessee as yes and also to mention the name of the LR while e-filing.
It is the "best departmental manner" for asking "Whether the person has gone away (from India) or far away." . Income Tax Department first believes in collecting the taxes. If tax is duly paid they are not bothered whether the assessee is alive or dead. .
