our cliant is a service provider of erection commissioning and installation service.is their any abatement is there and tell me the penality for non filing of monthly returns. the registration dt is sept,2010.please give suggestions, and give notification number and provide link

09 March 2011 Yes, the abatement is available vide notification no. 1/2006. The assessee can charge service tax on 25% of the total bill amount which shall be inclusive of the material. Also the assessee if availing the benefit of abatement, it cannot take the cenvat credit. Return under service tax has to be filed six monthly and not monthly. However, tax has to be deposited monthly. if it is deposited late, there is a interest @ 13% p.a.
