11 October 2007 ARE THERE ANY SPECIAL PROVISIONS WHICH HAVE TO BE TAKEN CARE OF WHEN THE COMPANY IS DEALING WITH ITS SISTER CONCERN ABROAD???????

11 October 2007 In case it is a subsidiary, then all the provisions which applicable to holding company (e.g. Section 212 of Companies Act,1956)shall be applicable.

However, you have to comply with FEMA and RBI guidelines for transactions with foreign company.

1) Transfer Pricing (as per IT Act)
2) Special Value Branch (SVB) (as per Customs)
etc.,

12 October 2007 Also take care of the Clear Agreements and also refer to DTAA in case of inquiries which is generally conducted after a quiet span of time, then the Trx Date
