Whether tds should be deducted or not?

01 September 2012 A restaurant is Receiving service of Bouncer from ABC industrial Guard Pvt. Ltd.But this company not charging service tax in bill.Still we can deduct TDS or not on estimation of contract services received ????

01 September 2012 TDS is related to income tax it has nothing to do with whether service tax is applicable or not. So TDS is dedutible.

01 September 2012 you should deduct if the provisions of income tax on tds is applicable.
there are no corelation between the service tax provisions and income tax provisions.
typically, an assessee is not chargeable to service tax if his turnover is below 100k but for tds provisions the amount of contract is too low.
even if his turnover is more than 100 k and not taken reg.and not collecting the service tax, he will attract penal provisions.
