Hello, I have completed my articleship of more than 2 years.During my articleship I was forced to work for more than 70 hours in a week. I had also to do the work of peon level. My prinipal always treated me as a slave during my articleship. Due to conflicts, I decided to get transfer on 09, March, 2009. I requested him to give the transfer but he assured me to give transfer after June,2009. He said me to discontinue from the office for the period of June to March. When new regulation (about articleship)came, I requested him to give transfer before 30th April, but he denied. Now he say I can not continue as I have demanded transfer and I can not get transfer as It's not possible according to the new regulation of Institute. I am in huge problem. NEED HELP.

That sounds like a really tough situation. Here’s what you can do regarding your articleship transfer under such circumstances:
1. **Grounds for Transfer After 1 Year:** After completing one year, ICAI permits transfer only on specific grounds such as:
* Medical reasons * Transfer of parent(s) to another city * Misconduct involving moral turpitude * Other justifiable reasons with proof (including harassment or mental cruelty) * Irregular or non-payment of stipend * Death or ceasing of practice of the principal
2. **Harassment and Forced Work** can be considered **misconduct or justifiable reason** to seek transfer.
3. **What You Should Do:**
* Write a formal application stating your grievances (harassment, forced excessive work, being treated unfairly). * Attach any evidence (if available) like emails, messages, witness statements. * Request a transfer on "misconduct involving moral turpitude" or "other justifiable reasons." * Send this application along with your principal’s refusal letter (if any) to ICAI regional office.
4. **ICAI's Role:** ICAI can intervene and grant transfer if they find your reasons genuine and your principal is uncooperative. They often mediate such disputes to protect students.
5. **Avoid Discontinuing Without Transfer:** ICAI does not recognize discontinuation unless officially transferred or terminated, so do not leave the office without proper documentation.
6. **Contact ICAI Student Support:** Immediately approach your nearest ICAI regional or branch office for assistance and submit a formal complaint.

If you want, I can help draft the application letter for transfer citing harassment and request for ICAI intervention. Would you like that?
