The trademark registration can be applied online through attorney. The registration procedure is prescribed under Trade Marks Act, 1999. If the person is running a proprietorship business then the trademark must be applied in the name of the owner of the Sole Proprietorship Business as there is no legal existence of sole proprietorship business.
The procedure for making the application is enumerated below in brief:
1. Consulting on applicability of the class according to the products/ activities of firm;
2. Trademark Search Report & availability check;
3. Drafting of required documents including GPA;
4. Online filing of application with the Registry along with the required documents.
Once the successful application is made, the applicant can use the TM mark beside the proposed Trademark.
